EULA - End User License Agreement

IMPORTANT -- READ THE FOLLOWING TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT ("LICENSE") CAREFULLY BEFORE INSTALLING ANY CALL OF THE San Base SCREENSAVERS.
By installing the San Base Screensavers, you signify your acceptance of the terms of this license and you agree to be bound by its terms and conditions. If you do not agree to these terms and conditions, do not install the San Base Screensavers.

CofteX+ Inc. produces a variety of "XXI Century Generative Art" screensavers ("San Base Screensavers") for Free distribution FOR PERSONAL USE.

FREE LICENSE FOR PERSONAL USE. SofteX+ Inc. grants you a non-exclusive license to use, install, and copy San Base Screensavers subject to the following restrictions:
You may exercise the foregoing license solely for your personal use. "Personal use" is defined as the private, non-commercial use of the San Base Screensavers, including copying to hard drive or CD-ROM for back-up purposes.

1. San Base FREE SCREENSAVERS do not have expiration dates and may be used on either a personal or work computer, or both.

2. YOU MAY NOT DISTRIBUTE San Base SCREENSAVERS IN ANY BULK MANNER, such as attaching one or more San Base Screensavers files to email messages, including one or more San Base Screensavers on a compilation CD-ROM, or making one or more San Base Screensavers available for download via the internet without express written permission.

Due to the file size and subsequent download times of San Base Screensavers, you are encouraged to include a link to the download or sceenshot pages in email messages rather than attaching a file. The recipient will appreciate the ability to download the San Base Screensavers at his/her own convenience.

3. YOU MAY NOT remove, disable or attempt to remove or disable any digital watermarks or other proprietary notices or markings that may be included with the San Base Screensavers.
TITLE. The San Base Screensavers are the proprietary and copyrighted materials of SofteX+ Inc. and/or its suppliers, and all rights, titles, and interests in and to the San Base Screensavers and the components (images, audio, etc.) used to create the San Base Screensavers remain with SofteX+ Inc. and its suppliers.

NO WARRANTIES. SofteX+ Inc. provides the San Base Screensavers to you "as is," without warranty of any kind, and SofteX+ Inc. specifically disclaims all warranties, expressed or implied, with respect to the San Base Screensavers including without limitation any implied warranties of merchantability and fitness for a particular purpose.
There is no warranty of Title or noninfringement for the San Base Screensavers.

LIMITATIONS OF LIABILITY. In no event shall SofteX+ Inc. be liable for any third party claims or any incidental, consequential or special damages arising out of this license or your use or inability to use the San Base Screensavers, even if SofteX+ Inc. has been advised of the possibility of such damages. In no event shall SofteX+'s liability (whether in Tort, Contract or otherwise) exceed the fee paid to SofteX+ Inc. for use of the San Base Screensavers.

TERMINATION. SofteX+ Inc. may terminate the License immediately if you fail to comply with its terms and conditions.

REVISIONS AND MODIFICATIONS. SofteX+ Inc. reserves the right to make revisions and modifications to this License so that the original intent of the license remains intact.
In the event it is brought to the attention of SofteX+ Inc. that one or more of the provisions can be held invalid or interpreted other than intended, the provision(s) shall be modified to maintain the integrity of the License, and the revised License shall be posted on the website.
